Please read this document carefully before placing an order or using our website. It outlines your rights and obligations, including limitations and exclusions that may apply.
These Terms and Conditions ("Terms") apply to the use of www.ncases.com ("Website") and to any purchases made through the Website. By placing an order, you agree to be bound by these Terms. NCASE LLC ("NCASE," "we," or "us") reserves the right to update these Terms at any time without prior notice. The latest version will always be available on the Website.
Order Acceptance & Fulfillment
Orders are charged immediately at checkout to secure your inventory allocation or production slot. Items in your cart are not reserved until checkout is complete and may become unavailable during the process.
Right to Cancel & Security Review
We reserve the right to accept, reject, or cancel any order at our discretion. This includes orders that are flagged by our payment security systems as "High Risk" or "Potential Fraud."
- Verification: In some cases, we may require additional information or verification (such as ID or address confirmation) before accepting an order.
- Cancellation: If an order fails our security review or if we are unable to verify the payment details, the order will be canceled and refunded immediately.
Fulfillment Timelines
- In-Stock Items: Typically processed and shipped within 2–3 business days.
- Made-to-Order / Pre-Order: Items marked as "Batch," "Pre-Order," or "Made-to-Order" are subject to the specific production timelines listed on the product page. By purchasing these items, you acknowledge that shipping dates are estimates and subject to manufacturing delays.
Order Modification
You may request changes to your order (e.g., product updates, quantity adjustments, or address corrections) within 48 hours of purchase. Many of our products are made-to-order, and once production or shipping begins, we are unable to modify your order.
Order Cancellation
If you wish to cancel your order, please notify us within 48 hours of purchase. After this period, cancellations may not be accepted. Once production or shipping has started, your order is considered final.
Non-Refundable Fees: Please note that Shopify, our payment processor, does not refund transaction fees (usually under 5%). Therefore, all refunds for cancellations will be issued minus this transaction fee. Refund processing time may vary depending on your bank.
Payment Terms & Currency
We accept payments through secure third-party processors. By submitting payment, you confirm that the information provided is accurate and that you are authorized to use the payment method.
- Payment Authorization: By placing an order, you explicitly authorize NCASE to charge your payment method immediately at the time of checkout, regardless of whether the item is In-Stock, Backordered, or Made-to-Order. You acknowledge that this upfront payment secures your inventory allocation.
- Currency & Conversion: The base currency of NCASE LLC is U.S. Dollars (USD). For your convenience, prices may be displayed and charged in your local currency based on your IP address.
- Exchange Rates: If you pay in a currency other than USD, the exchange rate is determined by the payment processor or your financial institution at the time of the transaction. NCASE has no control over these rates.
- Refunds & Fluctuations: Refunds are issued in the original currency paid. NCASE is not liable for any loss in value caused by exchange rate fluctuations between the date of purchase and the date of refund. The amount refunded will match the original transaction amount in the currency paid, regardless of the current exchange rate.
- Taxes: You are responsible for any applicable taxes, duties, or import fees associated with your order.
Shipping Policy
- Packaging: Orders are individually packaged and shipped separately by default. We do not combine shipments unless specifically stated.
- Shipping Rates: Rates are calculated at checkout based on size, weight, and destination. For remote or rural areas, as defined by the shipping carrier, additional fees may apply and will be invoiced separately if not included at checkout.
- Tracking: Tracking numbers are provided within 2–3 business days of shipment. Please note that some international tracking numbers may not update in real-time. However, if you do not receive a tracking number or if your tracking status fails to update, please contact our Chat Support immediately.
Shipping Delays & Force Majeure
We work hard to meet delivery estimates, but we are not responsible for delays caused by circumstances outside our control, including but not limited to:
- Weather events and natural disasters
- Customs delays or inspections
- Labor disruptions or strikes
- Global transportation issues or trade restrictions
- Pandemics or government-imposed restrictions
In such events, delivery timelines may be extended, and such delays do not constitute a breach of contract.
Customs & Duties
Import duties, taxes, and brokerage fees are not included in the product price or shipping cost. These charges are the sole responsibility of the customer and are collected by the carrier upon delivery.
- United States Customers: Due to current U.S. trade policies regarding international shipments, shipping and handling fees are included in the checkout price. While additional duties are currently uncommon for individual orders, they are determined solely by U.S. Customs and Border Protection. NCASE has no control over these charges. Additionally, if your order is fulfilled from our U.S. warehouse, applicable state sales tax will be automatically calculated at checkout. These taxes are mandated by state law and are not controlled or retained by NCASE.
- Refusal to Pay Duties: If a package is returned to us because the customer refused to pay customs duties or taxes, the cost of return shipping plus a 30% restocking fee will be deducted from any refund.
Address Accuracy & Carrier Validation
Customers must ensure that shipping information is accurate, complete, and formatted according to the shipping carrier's standards.
- Carrier Determination: The validity of a shipping address is determined solely by the shipping carrier’s database. If a carrier marks a package as "Undeliverable as Addressed" or "Insufficient Address" and returns it to us, this is considered a customer-error return.
- Disputed Accuracy: Even if you believe the address provided is correct, NCASE acts based on the carrier's classification. We are not responsible for delivery failures where the carrier cannot locate the address provided.
- Reshipment Costs: If a package is returned due to an address issue, the customer must pay a reshipment fee to have it sent out again. If the customer prefers a refund, it will be issued minus original shipping, return shipping costs, and the restocking fee.
Risk of Loss, Damage & Delivery Claims
1. Reporting Damaged Shipments
We insure all shipments to ensure your order is protected. To validate an insurance claim and receive a replacement or refund, we require the following from you:
- Notification Window: Please inspect your package upon arrival. Any damage must be reported to our Chat Support within 48 hours of delivery.
- Evidence Retention: To process a claim, the shipping carrier requires clear photos of the damage and the external packaging. Please keep all original boxes and packing materials until the claim is resolved.
- Claim Eligibility: Please note that we are unable to honor claims or provide replacements if the damage is reported outside the 48-hour window or if the original packaging has been discarded.
2. Delivery Confirmation & Liability
- Proof of Delivery: Our responsibility for the shipment concludes when the carrier marks the order as "Delivered." You agree that the carrier’s electronic delivery confirmation is sufficient proof that we have fulfilled our obligation.
- Lost or Stolen Packages: We are not responsible for packages that are lost or stolen after delivery has been confirmed. In such cases, we cannot offer refunds or replacements, but we recommend filing a report directly with the carrier or local authorities.
Return & Refund Policy
United States Orders (Returns Accepted)
We accept returns for orders shipped within the United States, subject to the following criteria:
- Return Window: Merchandise must be postmarked for return within 14 days of the delivery date.
- Condition: Items must be in unused, factory-new condition with all original packaging, foam inserts, and accessories included.
- Return Shipping: The customer is responsible for all return shipping costs. We strongly recommend using a trackable shipping method, as NCASE is not responsible for returns lost in transit. However, if the return is due to a verifiable product defect or NCASE error, we may provide a prepaid return label upon approval.
- Fees: Original shipping charges are non-refundable.
Return Process (RMA)
- Authorization Required: You must contact our support team via Chat Support to obtain approval before sending any item back. Unauthorized returns will not be accepted and may be returned to the sender at their expense.
- Shipping: Once approved, you must ship the item using a trackable shipping method. Please retain your tracking receipt.
- Restocking Fee: While standard returns in new condition are accepted, order cancellations made after the item has already shipped are subject to a 15% restocking fee to cover handling and processing costs.
International Orders (Final Sale)
To keep logistics costs viable, all sales shipped to destinations outside the United States are FINAL.
- No Voluntary Returns: We do not accept returns or exchanges for international orders due to buyer remorse, incompatibility, or refusal to pay customs duties.
- Remedy for Defects: In the event of a material defect or damage on an international order reported within 48 hours, NCASE reserves the right to provide replacement components to restore the product’s functionality. A full refund or exchange will only be authorized if the product is deemed irreparable by our tech team.
- EU Right of Withdrawal Waiver: As our products are produced in small batches or made-to-order based on customer demand, the standard EU Right of Withdrawal does not apply. All sales to the European Union are final.
Undeliverable & Refused Packages
If a shipment is returned to NCASE due to an incorrect address provided by the customer, failure to collect the package, or refusal to pay customs duties/taxes:
- Refund Deduction: A refund will be issued minus the original shipping cost, the return shipping cost charged to us by the carrier, and a 30% processing fee.
- Abandonment: If the package is abandoned by the carrier (not returned to us) due to non-payment of duties or failure to collect, no refund will be issued.
Refund Processing
We inspect all RMA cases every Thursday. If your return is approved during that cycle, we aim to issue refunds or ship replacements by the following Friday. Once approved, your refund will be issued to the original payment method minus applicable fees.
Warranty
NCASE provides a limited, non-transferable warranty covering defects in material and workmanship, beginning from the date of purchase. Warranty claims must be submitted within the covered period. Items missing parts must be reported within 7 days of delivery.
Bundles and Component Warranty
When purchasing a bundle or kit (e.g., Chassis + Cables + Accessories):
- Component-Specific Remedy: If a specific component within a bundle is found to be defective (e.g., a specific cable, screw pack, or bracket), NCASE’s liability is strictly limited to the replacement of that specific component.
- No Full Returns for Minor Defects: A defect in a non-essential accessory or replaceable component does not constitute a "failure of product" for the entire bundle. It does not entitle the buyer to return the entire unit (including the non-defective chassis) for a refund.
Product Revisions & Third-Party Content
NCASE regularly updates and improves its products. As part of our ongoing development process, product layouts, components, and design details may change without prior notice. The product you receive will always reflect the most current version available at the time your order is fulfilled.
Some third-party reviews or videos may feature earlier revisions of our products. These materials are not controlled by NCASE and may not represent current specifications. Differences between older content and the latest product version are normal and are not considered defects or grounds for a refund.
Liability & Indemnity
Except for obligations related to fulfilled orders, NCASE and its affiliates are not liable for any indirect loss or damages related to your use of the Website. You agree to indemnify us against all claims, losses, costs, and damages arising from misuse of the Website or violation of these Terms.
Dispute Resolution & Class Action Waiver
These Terms are governed by the laws of the State of Wyoming.
- Binding Arbitration: You and NCASE agree that any dispute or claim arising from these Terms or your purchase shall be resolved by binding arbitration rather than in court.
- Class Action Waiver: We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
